Definitions:<\/strong> The following definitions are intended to clarify the meaning of terms contained in the provisions of this agreement and to provide context for an understanding of the document, as a whole.<\/span><\/p>

(a). Dark Waters Entertainment \u2013 The company Dark Waters Entertainment, LLC<\/span><\/p>

(b) User \u2013 A person who has signed up through the Dark Waters Entertainment LLC\u00a0 Website (http:\/\/iamdarkwaters.com)<\/span><\/p>

(c) digital product(s) \u2014Intangible good(s) that exist in the digital form purchased through the Dark Waters Entertainment LLC Website (http:\/\/iamdarkwaters.com)<\/span><\/p>

Refund and returns<\/b><\/p>

If you are unable to view or access the digital product(s) purchased from the Dark Waters Entertainment LLC website for any reason including, but not limited to, browser\/compatibility internet connectivity, you may request a refund by following the procedures outlined in this document.<\/span><\/p>

Dark Waters Entertainment, LLC<\/strong> will review each request and retains the right access server and website statics to confirm whether said digital product(s) have been accessed by the user requesting the refund and the duration of time spent watching \/ consuming said content. Dark Waters Entertainment , LLC<\/strong> has the sole discretion to determine as to whether a refund will be issued to a person who has been determined to have accessed all or part of said digital content. Upon successful review and acceptance of the refund request, Dark Waters Entertainment LLC<\/strong> will refund the payment made no later than 15 calendar days from day of refund request.<\/span><\/p>

Procedure for refund request:<\/b><\/p>

Send an e-mail to “<\/strong><\/span>cancel@iamdarkwaters.com<\/strong>“<\/strong> with the reason for the refund request, the order number (which should have been provided in the e-mail receipt confirmation and on the redirected checkout page upon order completion) and if possible the technical specifications for the particular computer or mobile system used to purchase the product(s)<\/span><\/p>

Recurring billing and order cancellation:<\/b><\/p>

For product(s) marked as subscriptions and broken down by specified time periods, Dark Waters Entertainment LLC retains the right to automatically renew such products and re-charge the order for a maximum of 5 years from the original date of purchase. Unless specifically canceled by the user, orders will continue to be processed using the securely stored billing information provided at time of purchase. The user will retain the ability to access the premium digital content under the same or modified terms and conditions as with the original purchase.<\/span><\/p>

Automatic renewal:<\/b><\/p>

Unless you notify Dark Waters Entertainment, LLC<\/b>\u00a0 before the end of the applicable subscription period that you want to cancel, your subscription will automatically renew and you authorize us to collect the then-applicable annual or monthly subscription fee using any credit card or other payment mechanism we have on record for you. Subscriptions can be canceled at any time by following the procedures for cancellation outlined in this document.

Procedure for canceling automatic recurring billing:<\/b><\/p>

Send an e-mail to \u201c<\/strong><\/span>cancel@iamdarkwaters.com<\/strong>\u201d<\/strong> with the original order number for the subscription based product and with the subject \u201cCancel Subscription\u201d<\/span><\/p>

Updating billing information:<\/b><\/p>

Billing information can be updated via the<\/span> Dark Waters Entertainment LLC<\/b>\u00a0 website by accessing the “my subscription” tab on a user’s profile while logged in.<\/span><\/p>

Security and data:<\/b><\/p>

Dark Waters Entertainment LLC\u00a0 <\/b>uses an industry standard gateway for payment processing through Authorize.net which adheres to modern security protocols. Customers agree to indemnify <\/span>Dark Waters Entertainment LLC<\/b>\u00a0 against any breach of data or security out of their direct control and not deemed directly relocatable to their negligence, which includes but is not limited to security breaches due to: sharing of passwords and hacking. <\/span><\/p>

Indemnification:<\/b><\/p>

You agree to indemnify and hold harmless Dark Waters Entertainment LLC , its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorney’s fees, arising out of your use of the Website, including but not limited to your violation of this Agreement.<\/span><\/p>
